Lessons Learned from Recent Enforcement Actions of Fraud, Waste and Abuse Laws

Health care fraud, waste, and abuse laws are so broad and ambiguous that providers often cannot feel confident in making business and operational decisions. Even commonplace business practices can be fraught with regulatory risk. The federal government’s continuing efforts to investigate and take action against violations of such laws compound providers’ unease. In Fiscal Year 2019 alone, the federal government secured $2.6 billion in health care fraud settlements and judgements. This presentation will identify the key laws utilized by the federal government in enforcement actions. To help provide some clarity on the application of such laws, the presenters will discuss recent governmental reports, enforcement actions, cases, and settlements involving home health agencies and hospices. Finally, the presenters will discuss lessons that can be learned from such cases.
